SPECIAL MEASURES OF MOJ
If in the Register, no appropriate adopters are entered, and the Council for International Adoption is not able to determine appropriate adopters among the persons registered or the determined adopters have refused adopting a child with a health problem, special needs or over 7 years old, the Minister of Justice shall undertake the following special measures:
1. To publish on a monthly basis between the 25th and 30th day on the official website of the Ministry general information about each child;
2. To provide information and detailed data about the specificities of the particular child with regard to submitted application by a Bulgarian accredited organization; if necessary a photo may be provided, too; to the application shall be enclosed a statement with notarized certification of signature that the data and the photo will be used only as intended.
The accredited organization to which the materials and the documents have been provided, undertakes to return them if within two months after receipt of the information, no application for adoption has been filed by an adopter in the Ministry of Justice.
The filed application for adoption of a child shall be considered immediately. It shall be accompanied by the documents necessary to enter in the Register. In case of any discrepancies in the application or in the enclosed documents, the Ministry of Justice shall notify the accredited organization and shall give instructions for their elimination. The dely of 30 days will not apply in this case.
The information about the children may be provided to a government authority or to a foreign accredited organization nominated by such government authority in the event that a contract has been executed to this end.
SPECIAL NEEDS PROGRAM
This is an adoption program for children with special needs and older children. The legal regulation of the program is set in Art. 40 of Ordinance 3/24.10.2014. The Ministry of Justice publishes in Bulgarian the complete list of children with special needs every month. The published information concerns the children's health, held examinations, mental and social state. It does not contain any personal data. Registered candidate-adoptive parents as well as not registered candidates can apply for the children from the Special Needs lists. They have to sign an Application and some preliminary documents, which could be sent to New Beginning Association via fax or scanned by e-mail.
When registered candidates apply, New Beginning Association will submit an application to the Ministry of Justice. The application will be reviewed by the Adoption Council. A “Child Proposal" pack of documents will be sent to New Beginning Association, which will be translated and forwarded to the candidate(s). The procedure will afterwards follow its normal course.
An extra advantage of the SN program is the opportunity for not registered candidates to apply for children with special needs. After receiving a Power of Attorney and Application form from the candidate(s), New Beginning Association will submit an application for the particular child/ren to the Ministry of Justice. Then the Adoption Council will match the candidate(s) with the child and will put the case on hold until the candidates‘full paperwork has been prepared. The legal deadline for the preparation process is 6 mounts but could be extended with 3 more months, if necessary. After receiving all registration documents, Family New Beginning Association will file an enrolment application for the candidate(s). The candidate-adoptive parent(s) will be registered with priority and no delays. After registration, the Adoption Council will review the case again and will send the “Child Proposal" to New Beginning Association, which will be forwarded to the candidate(s). The procedure will then follow its normal course.
In accordance with legislation, New Beginning Association forwarded with children from the special needs list at any given time. We also have photos of children from the SN program at our disposal. For most of them, we can provide detailed additional information, videos and further examinations records (e.g. medical).
